Brief summary of accident:
On December 24, 2009, I was traveling in the right lane of the I59 South feeder road near Deerbrook Mall, Humble, TX. I was struck in the rear driver’s side quarter panel. I went to the Kingwood Medical center emergency room for a check up – I was experiencing neck and upper back pain. I was examined by the ER doctor on duty and x-rays were taken. I was given meds and prescriptions for muscle relaxers and pain medication. It was determined that I had muscle damage. The following Monday, I started treatment at Koala Health and Wellness Center. From December 28, 2009 to February 11, 2010, I was seen 23 times for muscle work to my neck and upper back. In addition, I have 3 follow-up visits to make sure the work that was done is holding.
I was told that I would be reimbursed as follows:
1. lost wages
2. medical up to the point of settlement
3. medical after the point of settlement including follow up visit
4. inconvenience
The medical would include mileage, parking, prescriptions, and doctor’s visits.
The lost wages would include all time taken off work.
The inconvenience would include additional time taken to doctor’s visits, missed volunteer work, and what use to be known as pain and suffering.
To date, I have spent $159.50 for parking (Koala is downtown in the Continental building); driven 1,304 miles (I work near IAH and I live in Kingwood); spent a total of 89 hours (includes 49 sick and annual leave hours taken off work); for a total of $2,328.43 (includes $1,643.17 not reimbursed by wages) for the doctor visits. All of this is documented and was provided to the insurance company for reimbursement.
The insurance company wants to reimburse me approximately $8,900 – medical (Kingwood and Koala up through February 11 – nothing for the 3 subsequent visits that were ordered by the doctor and I have not been released from their care yet), some parking, medical mileage for driving my own car (I had a rental from Dec 24 – Jan 25), partial wages, and $1,000 for inconvenience.
